Minor Release of Liability:
I, the minor’s parent and/or legal guardian, understand the nature of the activity and the minor’s experience and capabilities and believe the minor to be qualified, in good health, and in proper physical condition to participate in such activity. I hereby release, discharge and covenant not to sue and agree to indemnify and save and hold harmless each of the releasee’s from all liability claims, demands, losses or damages on the minor’s account caused or alleged to be caused in whole or in part by the negligence of the “releases” otherwise, including negligent rescue operations and further agree if despite this release I, the minor, or anyone on the minor’s behalf makes a claim against any of the releasees named above, I will indemnify, save and hold harmless each of the releasees from any litigation expenses, attorney fees, liability loss, damage or any cost that may incur as the result of such claim. Furthermore, I acknowledge, agree and understand that my child or I may be required to leave the premises and may be prohibited from further participation in SMS Lacrosse Inc., activities and will receive no refunds of any kind including but not limited to team fees, tournaments fees and cost of travel, should my child or I exhibit undesirable conduct , but is not limited to: fighting, breaking game rules that promote safe play and being verbally abusive to any event representative; including but not limited to referees, coaches, spectators and other participates.
Waiver:
In consideration of being permitted to participate in any way in SMS Lacrosse including but not limited to, any tournaments, teams, leagues, camps, clinics, and/or practices I, for myself for personal representatives, assigns, heirs, and next of kin:
(i) Acknowledge, agree, and represent that I understand the nature of the activity and that I am qualified, in good health, and in proper physical condition to participate in said activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.
(ii) Fully understand that:
(a) The activity involves risks and dangers of serious bodily injury, including but not limited to permanent disability, paralysis and death (“Risks and Dangers”)
(b) These Risks and Dangers may be caused by my own or my minor’s actions or inactions, the actions or inaction's of others participating in the activity, the condition in which the activity takes place, or the negligence of the "releasees" named below;
(c) There may be other social and economic losses unforeseeable or known to me at this time. I fully accept and assume all such risks and all responsibility for losses, costs and damages I incur as a result of my participation or that of the minor in the Activity
(iii) Hereby release, discharge and agree not to sue SMS Lacrosse Inc, any officer/owner of SMS Lacrosse, their respective administrators, coaches, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and leasers of premises on which the activity takes place, (each considered one of the "releasees" herein) hereby release, discharge and agree not to sure SMS Lacrosse Inc from all liability, claims, demands, losses or damages on my account caused by or alleged to be caused by in whole or in part by the negligence of the "releasees" or otherwise, including negligent rescue operations and I further agree that if, despite this release and waiver, I, or anyone on my behalf makes a claim against any of the releasees, I will indemnify, save and hold harmless each of the releasees from any litigation expenses, attorney fees, loss, liability, damage or cost that may incur as the result of such claim.
I have read this agreement and fully understand its terms. I understand that I have voluntarily given up known rights by agreeing to this and I have agreed to this freely and without inducement or assurance of any nature and intend it to be a complete and unconditional release of ALL liability to the greatest extent allowed by law.
I agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
Photographs and Images use authorization
I do hereby grant permission to SMS Lacrosse Inc. its owner(s), officer(s), trustee(s), employee(s), agent(s), representative(s), successor(s), licensee(s) and assign(s) to photograph the image of the registered player herein, likeness or depiction.
I hereby grant permission to SMS Lacrosse to edit, crop, or retouch such photographs, and waive my rights to inspect the final photographs.
I hereby consent to and permit photographs of the registered player herein and or those of my minor children to be used by SMS Lacrosse for educational and/or advertisement purposes, and in any medium, including print and electronic.
I understand that SMS Lacrosse Inc may use such photographs without associating any names thereto.
I further waive any claim against SMS Lacrosse for compensation of any kind for use or publication of photographs of me, the registered player or those of my minor children.
I hereby fully and forever discharge and release SMS Lacrosse Inc., from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of name, likeness, or image arising out of the use or publication of photographs of me, the registered player herein or those of my minor children by SMS Lacrosse Inc., and agree not to sue or otherwise initiate legal proceedings against SMS Lacrosse Inc., for such use or publication on my own behalf or behalf of the registered players herein or on behalf of my minor children. All grants of permission and consent, and all covenants, agreements and understandings contained herein are irrevocable.
